Possession of a Controlled Substance
Health & Safety Code § 11350 HS. An individual may be charged with a felony if in possession of controlled substances. A controlled substance under 11350 HS includes cocaine, cocaine base, heroine and prescription drugs such as codeine or hydrocodone (if individual lacks lawful prescription).
The individual charged under 11350 HS does not have to be using, selling, or under the influence of the drug. Possession is a felony with a penalty of up to 3 years in state prison.
