Penal Code § 207. Kidnapping is the use of force or fear to take an individual and move them a substantial distance. The penalties and punishment for a kidnapping conviction is up to 8 years in state prison. More time will be served if there was injury, abuse, if the victim was a child, or if the kidnapping occurred to facilitate another crime.
